1. GENERAL PROVISIONS
1. The online store www.rtools24.com, operating at the address www.rtools24.com, is run by: R-techniQ Sp. z o.o., with its registered office at Rozwojowa 28, NIP: 8733269251, REGON: 382038268.
2. These Online Store Terms and Conditions define the rules for making purchases in the online store www.rtools24.com, in particular the rules and procedure for concluding distance sales contracts via the Store, as well as the complaint procedure and the procedure for withdrawal from the contract by the Consumer.
3. With regard to Services provided electronically, these Terms and Conditions constitute the regulations referred to in Article 9 of the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws of 2020, item 344, as amended).
4. The Terms and Conditions are addressed to all Store Customers. All Customers are obliged to familiarize themselves with the provisions of the Terms and Conditions before making a purchase.
5. Each Customer is obliged to comply with the provisions of the Terms and Conditions. Sales are conducted based on the version of the Terms and Conditions in force at the time of placing an order.
6. Each Customer may review the Terms and Conditions at any time by clicking the “Store Terms and Conditions” hyperlink on the Store’s website. The Terms and Conditions may be downloaded and printed at any time.
7. All information contained on the Store’s website, including product descriptions and prices, does not constitute an offer within the meaning of Article 66 of the Civil Code, but constitutes an invitation to conclude a contract pursuant to Article 71 of the Civil Code. By submitting the Order Form, the Customer submits an offer to purchase and deliver the selected Goods at the price and under the conditions specified in the description.
2. DEFINITIONS
Terms and Conditions – these Terms and Conditions governing the use of the Store’s Services.
Consumer – a natural person concluding a contract via the Store for purposes not directly related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person concluding a civil law contract via the Store directly related to their business activity, where the contract does not have a professional character for that person, as resulting in particular from the subject of their business activity registered in the Central Registration and Information on Business (CEIDG).
Customer – a natural person (including a Consumer) who is at least 13 years old (with the consent of a legal guardian), a legal person, or an organizational unit with legal capacity, using the Store’s Services.
Order Form – a service available on the Store’s website enabling the Customer to place an order, in particular by adding Goods to the Cart and selecting delivery and payment options.
Cart – a Store element displaying the Goods selected by the Customer and enabling modification of the order details, including quantities.
Store – the online service owned by the Seller, available at www.rtools24.com, through which the Customer may purchase Goods.
Seller – R-techniQ Sp. z o.o., with its registered office at Rozwojowa 28, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000774068, NIP: 8733269251.
Goods – movable items being the subject of trade between the Store and the Customer.
Goods with Digital Elements – goods containing or connected with digital content or a digital service in such a way that the absence of such digital content or service would prevent proper functioning.
Product – any goods or service, including real estate, digital services, digital content, as well as rights and obligations.
Digital Environment – computer hardware, software and network connections used by the Consumer to access or use digital content or digital services.
Integration – the connection of digital content or a digital service with elements of the Consumer’s digital environment and incorporation thereof to ensure compliance with the contract.
Compatibility – the ability of digital content, digital services or goods to work with hardware or software typically used for goods of the same type, without conversion.
Functionality – the ability of digital content, digital services or goods to perform their intended functions.
Interoperability – the ability of digital content, digital services or goods to work with hardware or software other than those typically used.
3. CONCLUSION OF THE SALES CONTRACT
1. The conclusion of the Sales Contract between the Customer and the Seller takes place after the Customer submits an Order via the Order Form available on the Store’s website in accordance with Section 2 of these Terms and Conditions.
2. After placing the Order, the Seller immediately confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt and acceptance of the Order for processing is sent to the Customer by the Seller in the form of an e-mail message sent to the e-mail address provided by the Customer when placing the Order. Upon receipt by the Customer of the above e-mail message, a Sales Contract is concluded between the Customer and the Seller.
3. The content of the concluded Sales Contract is recorded, secured and made available to the Customer by making these Terms and Conditions available on the Store’s website and by sending the Customer a confirmation e-mail.
4. PRICES AND PAYMENT METHODS
1. The prices of Goods listed on the Store’s website are expressed in Polish zlotys (PLN) and are net prices (excluding VAT), unless clearly stated otherwise.
2. The final amount payable by the Customer consists of the price for the Goods and the delivery costs, about which the Customer is informed on the Store’s website during the ordering process and at the time of expressing consent to conclude the Sales Contract.
3. The Customer may choose one of the following payment methods:
a) bank transfer to the Seller’s bank account,
b) electronic payment via available payment systems,
c) cash on delivery – if such a form of payment is available.
4. The Seller shall issue a VAT invoice for the purchased Goods.
5. In the case of choosing payment by bank transfer, electronic payment or payment card, the Customer is obliged to make the payment within 7 calendar days from the date of conclusion of the Sales Contract.
5. DELIVERY
1. Delivery of the Goods is available within the territory of the Republic of Poland and to selected European Union countries.
2. Delivery of the Goods to the Customer is chargeable, unless the Sales Contract provides otherwise. Delivery costs are indicated on the Store’s website, in the shopping cart, and during the order placement process.
3. The Seller shall make every effort to deliver the Goods within the time limit specified in the product description, however no later than 30 days from the date of conclusion of the Sales Contract.
4. In the event of a delay in delivery of the Goods, the Seller shall inform the Customer immediately, indicating the reason for the delay and the expected delivery date.
5. Delivery of the Goods is carried out via courier companies or postal operators.
6. RIGHT OF WITHDRAWAL FROM THE CONTRACT
1. A Consumer who has concluded a distance Sales Contract may withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs specified in point 8 of this section.
2. The withdrawal period expires after 14 days from the day on which the Consumer took possession of the Goods or on which a third party other than the carrier and indicated by the Consumer took possession of the Goods.
3. To exercise the right of withdrawal, the Consumer must inform the Seller of their decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or e-mail).
4. The Consumer may use the model withdrawal form provided by the Seller, but this is not obligatory.
5. To meet the withdrawal deadline, it is sufficient for the Consumer to send information concerning the exercise of the right of withdrawal before the withdrawal period has expired.
6. In the event of withdrawal from the contract, the Seller shall reimburse all payments received from the Consumer, including the costs of delivery of the Goods (with the exception of additional costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard delivery method offered by the Seller), immediately and in any event not later than 14 days from the day on which the Seller is informed of the Consumer’s decision to withdraw from the contract.
7. The Seller shall make the reimbursement using the same means of payment as used by the Consumer in the initial transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer shall not incur any fees as a result of such reimbursement.
8. The Seller may withhold reimbursement until the Goods are received back or until the Consumer has supplied evidence of having sent back the Goods, whichever is the earliest.
9. The Consumer shall return the Goods or hand them over to the Seller immediately, and in any event not later than 14 days from the day on which the Consumer informed the Seller of the withdrawal from the contract.
10. The Consumer shall bear the direct cost of returning the Goods.
11. The Consumer is liable only for any diminished value of the Goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Goods.
7. COMPLAINTS AND WARRANTY
1. The Seller is obliged to deliver Goods that are free from defects and compliant with the Sales Contract.
2. The Seller is liable to the Consumer for lack of conformity of the Goods with the contract under the rules set out in applicable legal provisions.
3. Complaints may be submitted in writing or electronically to the Seller’s contact details provided in these Terms and Conditions.
4. It is recommended to include in the complaint a description of the defect, the date of its occurrence, the Customer’s request and contact details.
5. The Seller shall respond to the complaint immediately, but no later than within 14 days from the date of its receipt.
8. ELECTRONIC SERVICES
1. The Seller provides electronic services via the Store, including enabling Customers to place orders, maintain a Cart and use the Order Form.
2. The use of electronic services is free of charge.
3. Technical requirements necessary to use the Store include a device with Internet access, a web browser and an active e-mail account.
4. The Customer is prohibited from providing unlawful content.
5. Complaints regarding the provision of electronic services may be submitted in accordance with the complaint procedure set out in these Terms and Conditions.
9. PERSONAL DATA PROTECTION
1. The administrator of the Customers’ personal data is the Seller.
2. Customers’ personal data are processed for the purposes of order processing, performance of the Sales Contract, handling complaints and, if the Customer has given separate consent, for marketing purposes.
3. Providing personal data is voluntary, however necessary to conclude and perform the Sales Contract.
4. The Customer has the right to access their personal data, correct them, request their deletion or restriction of processing, as well as the right to data portability, in accordance with applicable legal provisions.
5. Detailed rules concerning the protection of personal data are set out in the Privacy Policy available on the Store’s website.
10. FINAL PROVISIONS
1. Contracts concluded via the Store are concluded in the Polish language.
2. Matters not regulated in these Terms and Conditions shall be governed by the generally applicable provisions of Polish law.
3. The Seller reserves the right to amend these Terms and Conditions for important reasons, including changes in legal regulations, changes in payment or delivery methods, to the extent that such changes affect the implementation of these Terms and Conditions.
4. Amendments to the Terms and Conditions shall not affect rights acquired by Customers prior to the effective date of such amendments.
5. The Terms and Conditions enter into force on the date of their publication on the Store’s website.
